HOURS OF OPERATION. Unless agreed otherwise, Member may use the services Monday - Friday, 8:30 am to 5:00 pm, holidays excluded. For a list of Connect's holiday schedule please reference: Hours & Days of Operation. Connect may access Member’s space at all times, including without limitation, in an emergency, for cleaning, inspection, showing to prospective Members, but shall endeavor to respect Member’s reasonable security procedures.
NO UNLAWFUL OR PROHIBITED USES. Member shall not use the services for any purpose that is unlawful, prohibited by these terms and conditions, in any way which would damage or impair any servers or networks maintained by Connect, in any way which would constitute a nuisance or increase the insurance cost of the building, or interfere with any other party’s use of the services. Member shall at all times comply with all laws, rules, and regulations governing their business.
MEETING/CONFERENCE ROOM USAGE. If Member's Service Package includes access to meeting or conference rooms, Member will receive contact information for scheduling and confirming Member's use. Member understands and agrees that scheduling of conference rooms and offices is on a first-come, first served basis. Member acknowledges that Member's account will be charged a 1 -hour minimum per scheduled use and then in 1-hour increments thereafter. Hourly use amount will be billed at the then currently published hourly rates. Member agrees to adhere to Connect's cancellation policy which requires written cancellation 48 or more hours in advance of the start of the scheduled use to avoid being charged the full amount of the reservation. Member may be required to pre-pay for contracted services such as catering and specialized audio-visual equipment. Member must be present at time of use.
IT USAGE: Members may not install any cabling, IT or telecom connections without the consent of Connect, which may be withheld in Connect’s sole discretion. In the event Connect grants said consent, Connect shall be permitted to oversee all installations and verify that such installations do not interfere with use by Connect, other Members, or landlord of the building. Any fees connected with said installation and consent shall be paid solely by Member.
OUR LIMITATION OF LIABILITY. Member acknowledges that due to the imperfect nature of verbal, written and electronic communications, neither Connect nor Connect's affiliates, Connect or any of their respective officers, directors, employees, partners, agents or representatives shall be responsible for damages, direct or consequential, that may result from the failure of Connect to furnish any service, including but not limited to the service of conveying messages, communications and other utility or services. Member's sole remedy and Connect's sole obligation for any failure to render any service, any error or omission, or any delay or interruption of any service, is limited to an adjustment to Member's bill in an amount equal to the charge for such service for the period during which the failure, delay or interruption continues.
WITH THE SOLE EXCEPTION OF THE REMEDY DESCRIBED ABOVE, MEMBER EXPRESSLY AND SPECIFICALLY AGREES TO WAIVE, AND AGREES NOT TO MAKE, ANY CLAIM FOR DAMAGES, DIRECT OR CONSEQUENTIAL, INCLUDING WITH RESPECT TO LOST BUSINESS OR PROFITS, ARISING OUT OF ANY FAILURE TO FURNISH ANY SERVICE, ANY ERROR OR OMISSION WITH RESPECT THERETO, OR ANY DELAY OR INTERRUPTION OF SERVICES, CONNECT DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE IN TRADE. THIS AGREEMENT DOES NOT CREATE A TENANCY INTEREST, LEASEHOLD ESTATE, OR ANY OTHER INTEREST IN REAL PROPERTY. IT IS A CONTRACTUAL ARRANGEMENT THAT CREATES A REVOCABLE LICENSE.
