LIABILITY
Renter agrees to indemnify, defend, and hold LES SCARLETT INC, its landlord, building owners, employees, and agents harmless of and from any liabilities, costs, penalties, or expenses arising out of and/or resulting from the rental and use of the premises, including but not limited to, the personal guarantee of provision, service, and dispensing of payment by renter, its employees, and agents of alcoholic beverages at LES SCARLETT INC
In the event LES SCARLETT INC , its landlord, building owners, employees and/or agents, are required to file any action in court in order to enforce any provisions of this agreement, renter agrees to pay LES SCARLETT INC, its landlord, building owners, employee as and/or agents, all reasonable attorney fees, court fees, and costs of suit incurred by LES SCARLETT INC, including all collection expenses and interest due.
In the event of an act of god, state of emergency (i.e. COVID-19) or pandemic, LES SCARLETT INC will not be issuing any refunds. However, renter agrees to use the full amount of their payment towards a future event date agreed upon within one calendar year in writing via email

CONDUCT
• There is absolutely no drug use or smoking of any kind tolerated on premises or within 25 feet of the building including loitering
• There is no serving of Alcohol without permit.
• THERE IS NO congregating outside on the sidewalk at any time during the event. (THE EVENT MUST TAKE PLACE INDOORS OR IN THE BACKYARD)
Disparaging remarks or any type of physical violence will not be tolerated and will be cause for immediate expulsion.
• Conduct deemed disorderly at the sole discretion of LES SCARLETT INC staff shall be grounds for immediate expulsion from the premises and conclusion of the rental period.
• IN SUCH CASES NO REFUND OF THE EVENT COST SHALL BE MADE.
LIVE MUSIC/DJs/NOISE
LES SCARLETT INC encourages music and lots of dancing! However, please be aware that the premises are located near residential units and therefore neighborhood noise regulations do apply. in the event that renter’s event creates a disturbance due to high noise volume, LES SCARLETT INC. onsite manager et all or designee has full authority to ask the renter, DJ or live music presenter to turn the entertainment down and/or off.
• If repeated disturbances are created, at LES SCARLETT INC discretion, renter may be expelled from the premises or the offending noise will be ended.
• In the event of disturbances to the point of expulsion, no portion of the event costs will be refunded to renter.
• Loud music must end by 10:00 PM. during weeknights (Monday through Thursday) and by midnight on weekends (Friday through Sunday). additional time can easily be added provided the volume is modest and it cannot be heard beyond the boundaries of the property or by immediate neighbors.
• Loud bass can not and will not be tolerated.
CANCELLATION
Date-Hold deposits are NON-REFUNDABLE $200. If for any reason there is a cancellation, renter may book a future date within one year from the date of their deposit based on the event space availability.
CITY, COUNTY, STATE AND FEDERAL LAWS
Renter agrees to comply with all applicable city, county, State, and Federal laws and shall conduct no illegal act on the premises. This is a drug free and non-smoking facility at all times, NO EXCEPTIONS. renter shall not sell alcohol on premises at any time without permit. renter may not serve alcohol to minors on the premises at any time. renter agrees, for everyone’s safety, to ensure alcoholic beverages are consumed in a responsible manner. LES SCARLETT INC reserves the right, in its exclusive discretion, to expel anyone who in its judgment is intoxicated or under the influence of alcohol or drugs, or who shall in any manner do or participate in any act jeopardizing the rights, use permit, or insurability of LES SCARLETT INC or the safety of its staff, guests, or building contents.
ENTRY AND EXIT
Renter agrees that LES SCARLETT INC staff may enter and exit premises during the course of the event. A representative of LES SCARLETT INC may be on site during the duration of your event and may be checking periodically with the responsible parties to ensure everything is running smoothly. We will also be checking the bathroom, the overall premises, replenishing hand towels and toilet paper, and will be available for questions or to respond to needs or issues that may arise at any time.
LOST AND FOUND
LES SCARLETT INC will take no responsibility for personal effects and possessions left on premises during or after any event. We do, however, maintain a lost and found and will hold recovered items up to 7 business days. Every attempt will be made to return any recovered item to its rightful owner.
CLEANING
Renter agrees to clean all tables, chairs and areas used in the event space. Renter agrees to dispose of all garbage and materials in the black and blue bins located in the events space before the event ends.
CLEANING DEPOSIT
AN ADDITIONAL $100 CLEANING DEPOSIT THAT IS NECESSARY FOR EVERY RENTAL. IF/ WHEN THE SPACE IS FOUND EXACTLY THE WAY YOU LEFT IT YOUR CLEANING DEPOSIT WILL BE RETURNED WITHIN 72 HOURS.
REFUNDS
If for any reason a refund is issued, it will be processed within 5 to 7 business days.
COVID-19- New York State
Due to COVID-19 restrictions from New York State, non-household gatherings (i.e., event venues) have restricted capacities. Our capacity restrictions are as followed for the following dates:
Currently, As of May 31, 2021: up to 50 people maximum indoor/outdoor, or 35 people seated maximum indoors
This capacity includes any vendors, staff and other personnel on site. Capacity limits may fluctuate according to applicable laws made effective for the date for your event—
Currently, As of August 17, 2021: people 12 and older are required to show proof they have received at least one dose of a COVID-19 vaccine authorized for emergency use by the FDA or WHO for indoor dining includes event spaces.
