COMPLIANCE WITH LAWS:
Lessee, its guests, invitees, employees, and agents shall comply with all municipal, state, and federal laws, rules, and regulations of the applicable regulatory agencies, while using the space.
PLANNING:
Lessee shall submit setup arrangements at least 10 days prior to the event so our personnel can be scheduled to staff your event. All designated equipment, catering, and rental deliveries must be scheduled with the event coordinator prior to the event.
RESTRICTED USE:
Lessee shall use designated event space, restrooms, furniture, and equipment listed herein as approved by the host. Unless otherwise specified, the retail space will continue with normal operations during business hours. The cafe and patio will be open to outside customers. No other space, interior or exterior, will be used without the consent of the event coordinator
EVENT SET-UP LIMITATIONS AND DECORATION:
All property and equipment belonging to Lessee, its guests, invitees, employees, and sub-contractors shall be delivered, set up, and removed on the day of the event. Should the Lessee need earlier access for set-up purposes, this can be arranged for an additional fee. The Lessee is ultimately responsible for property belonging to the Lessee, its guests, invitees, employees, and sub-contractors. All decorations are subject to the approval of Communal and are restricted exclusively to the rental space and date contracted for in the rental agreement.
● All areas are furnished and styled.
● The host will rent glassware, dishes, utensils, and table linens as outlined in the Attachment.
● No rice, birdseed, confetti, glitter, floating sky lanterns, fire pits, tiki torches, or sparklers are allowed on the premises.
● Candles must be enclosed in glass with at least 2” of space between the candle and the top of the glass container. No smoke or fog machines are allowed.
● The host's Florals are available at a 10% discount.
● Lights or other decorations may not be attached with nails, tacks, tape, string, fishing line, etc. to walls, ceilings, fixtures, fences, or plants without prior authorization.
● Bubbles may be used on the outside patio. Balloons may be used as long as they are disposed of at the close of the event.
● Lessee, its guests, invitees, employees, and sub-contractors may not disturb any items in the retail space.
● There will be a designated cabinet for event supplies/personal items. Other communal cabinets are not for use.
● No artwork or equipment shall be touched, or removed without prior consent.
CLEANING:
We ask that Lessee place all trash in receptacles at the end of the event and that the room is left in a similar manner as found. The facility should be relatively free of debris/spills. The host will be responsible for a deep cleaning between events. The host is not responsible for any property left behind by Lessee, its guests, invitees, employees, and sub-contractors.
OTHER RESTRICTIONS:
All spaces are non-smoking facilities. Children 12 years of age and under must be accompanied by an adult in the areas at all times. The operation of heating/cooling and any other infrastructure must be approved by the event coordinator.
No outside food and/or beverages are permitted. Outside desserts are permitted with no other exceptions.
DAMAGES:
Lessee shall pay the host for all damages to building, grounds, furniture, and equipment caused by the Lessee, Lessee’s invitees, guests, agents, and sub-contractors. If damage to the space occurs, damages are to be paid to the host within five days from the date a statement has been submitted to the Lessee by the host.
USE OF ALCOHOL:
Under the host's catering license, Lessee may purchase wine, beer, and wine-based spirit batch cocktails from the host to serve during events. Lessee shall also have the right to serve spirits in compliance with local, state, and/or federal law at the event mentioned herein, but must obtain and maintain the proper permits and/or licenses. Alcoholic beverages shall not be served to any person who appears to be adversely influenced or affected by alcohol or other substances. Lessee shall not serve alcohol to minors. The host has the right to remove from the premises anyone who appears to be adversely influenced or affected by alcohol or other substances or anyone who serves alcohol to minors.
SECURITY AND FIRE CODE:
The number of staff needed at each event will be determined by the event coordinator. The number will depend on the nature of the event and the number of people attending. The host, at their sole discretion, may mandate that additional security personnel are assigned to your event, which may involve additional fees over and above your facility rental fee. This will be agreed upon in advance with the lessee. Exits may not be blocked at any time during an event.
ATTORNEY’S FEES:
In the event, the host requires the services of an attorney to pursue any of the remedies available under the agreement against the Lessee, including filing a lawsuit, and Lessee is determined by a court of competent jurisdiction to be in default hereunder, the Lessee shall pay all costs and expenses, including, but not limited to, reasonable attorney’s fees incurred by the host in the enforced agreement.
ENTIRETIES:
Should any clause, paragraph, sentence, or section of this agreement be determined to be void, illegal, or otherwise unenforceable by a court of competent jurisdiction, the remaining provisions of the agreement shall not be rendered void and unenforceable as a result but rather shall remain in full force and effect.
AMENDMENTS:
No amendments or changes to this agreement shall be effective unless made in writing and signed by both parties. Lessee shall be responsible for enforcing the guidelines and rules set forth herein, and shall promptly report to the host any incidents which might adversely affect the facility. Lessee agrees to instruct any persons assisting Lessee of the rules and to instruct them to abide by the same. Anyone violating the terms of this agreement is subject to removal from the premises by the Lessor.
FORCE MAJEURE:
The ability to execute this Agreement by either party is subject to the Acts of God, including but not limited to hurricanes, flooding, earthquakes, fires, power outages, etc, as well as any government intervention, staff disputes, and strikes, civil disorders, terrorism, or other emergencies. Should the event be canceled through
a Force Majeure event, all fees paid by Lessee to the host will be returned to Lessee within thirty (30) days.
