• Rental of Facility o Shall not extend beyond 11 p.m. Friday or Saturday (Door must be locked by midnight) o Shall not extend beyond 10 p.m. Sunday through Thursday (Door must be locked by 11 p.m.) o For weekend events: door lock code will be sent Friday • Proof of Special Event insurance is required before occupancy o The User must add ArtsRevive as an “Additional Insured” to their Special Event Liability policy o Non-alcohol events require ½ million in coverage o Alcohol events require 1 million in coverage • 2 licensed, uniformed security guards are required to be present during the entire Event LICENSE TERMS: 1. ArtsRevive will license to User the use of its building, outdoor courtyard, and related facilities (together, the “Facilities”) located at 3 Church Street, Selma, Alabama, 36701, on the date and time of booking. 2. User understands that the Facilities shall be cleaned up by User on the same day of the Event. 3. The Facilities, including the outdoor courtyard portion, are nonsmoking and drug-free Facilities. All Users, guests, and vendors shall observe this policy. 4. Before occupancy, the User will provide Special Event Insurance NO REPRESENTATIONS – FACILITIES ACCEPTED “AS IS”: ArtsRevive makes no representations as to the condition of the Facilities or its fitness for any particular purpose. The user accepts the Facilities “AS IS.” TERMINATION: ArtsRevive reserves the right to terminate booking for any of the following: 1. Failure to pay deposits and fees promptly. 2. Change of intended use of the Facilities not approved by ArtsRevive. 3. Upon written notice to the User before the Event that the Facilities are required for ArtsRevive, including capital improvements and repairs. 4. The Facilities are rendered unfit or unavailable for the Event during the period covered by this Agreement, because of fire, earthquake, strike, civil disturbance, or any other cause beyond the control of ArtsRevive. (If this booking is terminated under clause (3) or clause (4) above, ArtsRevive shall refund the entire deposit to the User.) CANCELLATION BY USER: Sorry, NO REFUNDS will be given. In the event an emergency arises and cancellation is necessary, the User must contact ArtsRevive as soon as possible and each situation will be reviewed on an individual basis by ArtsRevive. ALCOHOL – COMPLIANCE WITH LAWS: User agrees to comply with all applicable local, state, and federal ordinances, statutes, laws, and regulations. ArtsRevive, by state law, forbids the service of alcohol to persons under the age of 21. Any violations will result in immediate termination of the Event. The sobriety of all guests is the responsibility of the User. INAPPROPRIATE BEHAVIOR: This is a community art facility. Inappropriate behavior, vandalism, or misuse of equipment will not be tolerated and may result in immediate expulsion from the Facilities. NO obscene language, loud music, or profanity will be tolerated. Noise/Music must be kept at acceptable levels. DRUGS, FIREARMS/WEAPONS, AND GAMBLING are prohibited from ANY Event. SMOKING is also prohibited inside the Facilities. DECORATIONS: Decorations must be flameproof and freestanding and are subject to the approval of ArtsRevive. ArtsRevive reserves the right to photograph the Event and otherwise publicize the Event to promote the Facilities. No decorations are to be taped, pinned, or nailed on the walls, curtains, windows, or doors of the building. No artwork located in the building shall be removed by the User. UPON LEAVING THE FACILITIES: User will: • Make sure the Facilities, surrounding property, and adjacent street areas are neat and orderly. • Additional clean¬ time may be scheduled for the following day. • All lights and fans should be turned off. • All doors should be locked and secure and the alarm set. • All trash must be placed in the building's trash cans Excess trash should be removed by the user. • All supplies brought in by the renter must be removed • Chairs (if used) must be stacked along one wall DAMAGES: In addition to the forfeiture of the deposit, the User will be liable for any damages caused to the Facilities. INDEMNITY: User agrees that he/she/it will indemnify, defend, and hold harmless ArtsRevive and its directors, officers, agents, employees, and volunteers free and harmless from and against any claims for damages and injuries to persons or property arising out of or in any way connected with User’s acts or omissions by User’s officers, employees, agents, vendors, contractors, guest, or invitees in their use and presence in the Facilities. User agrees that it will pay all costs of the Event and will indemnify ArtsRevive and its directors, officers, agents, employees, and volunteers against any claim or lien for unpaid costs. The provisions of this paragraph shall survive the termination of the license term.
