OUTDOOR USE
a. The Client understands that they, their guests, and all vendors will abide by the rules and
regulations of The City of Portland and our venue while utilizing the outdoor space. This
includes, but is not limited to, the following:
i. Placement of tables, tents, catering equipment, event décor, etc. must be approved by our management.
ii. All music and sound must be turned off by 10:00 PM Sunday through Thursday, and by
12:00 AM (midnight) Friday through Saturday.
iii. Absolutely no tobacco, marijuana, vaping, or illegal drug use. Smokers can exit the
premise and stand at least 10 feet from the patio gate or front doors.
iv. Use of sparklers, grills, or other flammable equipment must be approved by our venue
prior to the event and may be subject to other safety measures as required by state, city,
county, or local statues or regulations.
v. No furniture may be left outside overnight (tables, chairs, linens, umbrellas, etc.), with
the exception of tents upon prior approval.
ALCOHOL SERVICE
a. As the host of a private party, the Client acknowledges responsibility for the proper and lawful
consumption of alcoholic beverages at our venue for the entire duration of the event described
in this Agreement.
b. Alcoholic beverages will be purchased through our venue or the Client will provide product to our venue the day of the event. OLCC-licensed bartenders will handle all beverage service and
will be staffed through our venue (hourly rates apply).
c. Any alcohol on the premise that is not served through the Venue staff is deemed unlawful and is
considered cause to terminate the event immediately.
d. The Venue’s bartenders may refuse service to any person appearing under the age of 21 or any
person who appears to be intoxicated. Service will be refused at the sole discretion of the
bartender(s) on duty.
e. Identification and proof of age will be required from any person who appears to be under 26
years of age. Alcoholic beverages will be removed from anyone believed to be a minor or from
any intoxicated person.
f. Absolutely no underage drinking will be tolerated.
g. Alcoholic beverage service will end no later than 1:00 AM.
h. The Client agrees to fully cooperate and assist in enforcing the laws of the State of Oregon and
the Oregon Liquor Control Commission, and the policies of our venue regarding the
consumption of alcoholic beverages.
FOOD AND CATERING
a. If your event is catered, your catering company is responsible for the setup, breakdown, and
cleanup of the Venue’s kitchen and any additional areas of food prep and service.
b. The Client may select a caterer from the Preferred Vendor List. All food service must be provided
through a licensed and insured vendor, and no self-catering is allowed.
i. Caterers from Preferred Vendor List, will be charged a fee of 10% on total food sales to be
paid to us.
c. The selected caterer must provide a Certificate of Insurance with a $1,000,000.00 minimum
general liability, and the certificate must list Everett West as a co-insured.
d. Event trash must be disposed of in the designated areas at the end of the event.
e. All vendors (including florists, bakers, rental company, etc.) must adhere to the terms of our
guidelines, and it is the client’s responsibility to share these guidelines with them.
UNFORESEEN EVENTS
A party shall not be held liable for failure of or delay in performing its obligations under this
Agreement if such failure or delay is the result of an act of God, such as an earthquake, tornado,
fire, or other natural disaster or in case of war, terrorist activities, labor dispute or strike,
government sanction, blockage or failure of electrical (or other utility) service. Under such
circumstances, we will allow for the event to be rescheduled, pending availability, with
no penalty.
LIABILITY AND INDEMNITY
Our venue and its staff shall not be liable for any suit, actions, damages, and expenses in
connection with personal injury, illness, or property damage or theft resulting from the use of the
Venue’s property except for its own willful misconduct, gross negligence, or actions in bad faith.
GOVERNING LAW
This agreement shall be construed in accordance with, and governed in all respects by, the laws of
the State of Oregon, without regard to conflicts of law principles.
