The following list of rules, restrictions, and regulations are to be upheld by the GUEST, its officers, owners, personnel, employees, agents, contractors, invitees, volunteers, and/or any other parties involved in the special event at the CABIN.
1. Access/Scouting: Our home is often occupied. For safety and privacy reasons, please do not drive by, take pictures of, or walk on the property without prior expressed written consent from the LANDLORD.
2. Overnight Stays: This agreement does not confer any rights to overnight lodging at the CABIN. If overnight stays at the CABIN are desired, they must be booked separately by the GUEST, with a separate contract, security deposit, and cleaning fee.
3. Quiet Time/Hours: 10:00 pm – 8:00 am. We are located in a small and quiet residential neighborhood. Sound travels very far in the mountains. Outdoor sounds must end by 10:00 pm to comply with County sound ordinances and to avoid disturbing our neighbors.
4. Music: No outdoor amplified music allowed such as DJ’s or amplified musical instruments. A small Bluetooth speaker or acoustic music is permitted; outdoor music must be in accordance with our quiet time.
5. Furniture: Furniture may only be moved/rearranged with prior expressed written consent from the LANDLORD and under the proper handling/supervision of our local property manager. We have several high-end and antique/vintage pieces in the CABIN that can be damaged due to being moved and/or improperly handled.
6. Parking: There is a 3 vehicle maximum at the CABIN at all times, unless a permit allowing for additional vehicles is obtained by the GUEST from San Bernardino County (as is required for all shoots with visual recording processes that record motion). Street parking is prohibited unless appropriate permits have been obtained from the County.
7. All rules for the outdoor amenities (movie projector, fire-pit, etc.) must be followed by the GUEST at all times. This information is provided in the “House Manual”.
8. Decorations: Decorations may not be attached to any structure or surface at the CABIN with tape, wire, nails, screws or other fasteners that could cause damage. All decorations, rental items, and/or vendor equipment must be removed (with no residual evidence of their presence) at the end of the event.
9. Smoking: Smoking is only allowed outdoors, with all doors and windows to the CABIN closed, and more than 25 feet from any structure. Out of respect for the mountains and our property, the GUEST must remove all cigarette butts from the property to avoid additional cleaning fees.
10. Fire: Other than the propane fire-pit, no open fires are to be started at the CABIN. No candles, sparklers, fireworks, sky lanterns, etc. are permitted, per County laws. The outdoor fire-pit is propane only (solid fuel prohibited).
11. Animals: No Pets/Animals allowed unless they are taking part in shooting a scene; prior expressed written consent must be obtained by the LANDLORD.
12. Our property is recommended for individuals 12 years of age and older due to safety reasons. Our home is unfenced and not child-proofed.
13. Overtime rate is 1.5 times the hourly rate stated in this AGREEMENT. Overtime is calculated in minimum 30 minute increments.
14. Security Deposit: a $500.00 security deposit is required. This hold will be processed through PayPal.
15. Catering/Bar: All liquor must be served by an Insured Licensed Bartender. Alcohol may not be served to minors. Illegal substances are not allowed at any time at the CABIN. Drunken/Intoxicated/Violent disturbances are strictly prohibited and subject to immediate removal from the premises and possible termination of the event/booking without refund.
16. Guns or other deadly weapons are strictly prohibited.
17. Use of glitter or confetti at the CABIN is prohibited as it is impossible to clean up/remove. Minimum $500.00 additional cleaning fee will apply.
19. Restroom Use: Please do not flush anything other than human waste and toilet paper. No feminine products, diapers, wipes, condoms, paper towels or anything else should be flushed down the toilet at any time. If it is found that anything other than the above “approved” referenced items have been flushed - the GUEST agrees to incur all fees/expenses necessary in order to remediate the damages.
20. Fireplace: The indoor fireplace is a pellet burning stove and GUEST agrees to use only the pellets provided - no wood, lighter fluid, or any other combustible material is allowed in the fireplace. Never leave a fire unattended. While on/heating, GUEST agrees to take great caution as the exterior of the fireplace can be extremely hot.
21. EXTERIOR CAMERAS: Please note that for your safety and the safety of our property, five (5) exterior cameras are installed and monitor the exterior of the property (including the driveway, front door, back yard, upper deck, and lower back decks). The GUEST’s booking constitutes understanding and acceptance of all recordings. Any attempt to turn off, disable, move, re-direct, and/or cover the cameras is prohibited and will result in the forfeiture of the GUEST’s entire security deposit and cancellation of the GUEST’s reservation without a refund.
22. The GUEST is expected to leave the CABIN in the same condition in which it was received. Trash left behind is subject to a $50.00 per bag fee.
23. Insurance and Liability: The GUEST shall obtain General Liability Insurance in an amount not less than $1,000,000.00 Combined Single Limit for Bodily Injury and Property Damage. Such Insurance shall name the LANDLORD as an additional insured, and a certificate of insurance with an endorsement must be provided 14 days prior to the event. Additional Liability Insurance may be required by San Bernardino County (for all shoots utilizing visual recording processes that record motion); The GUEST booking our cabin for commercial purposes are responsible for contacting San Bernardino County and obtaining all permits required by law.
24. The GUEST and any/all Vendors working at the CABIN shall carry and maintain, in full force and effect while working at the CABIN, workers compensation insurance, general liability insurance, and a policy endorsement naming the CABIN as an additional insured.
25. Notwithstanding the requirement for such insurance, Guest shall be required to also hold
harmless, indemnify, and defend our cabin and us as the owners, to the maximum extent allowed by law, from any and all liability arising from Guests use of our cabin, including the payment of our cabin's reasonable attorney’s fees and costs incurred in defense of any actual or alleged liability. Guest agrees to sign a Hold Harmless Agreement and additional Location Agreement.
ADDITIONAL FEES:
Failure to comply with the terms of this AGREEMENT may result in additional fees. The GUEST agrees to reimburse the LANDLORD for repair/replacement costs of any damages sustained to the CABIN by themselves, their guests, and/or animals present during the stay (including those damages in excess of the $500.00 security deposit). Failure to comply with commercial permit limitations/restrictions may result in additional fees by the County of San Bernardino. The GUEST is responsible for any and all fines issued to the GUEST by the County for violating the terms of this AGREEMENT and/or County codes/ordinances. The GUEST also agrees to be responsible, and reimburse the LANDLORD for any and all fines issued for failing to obtain necessary permits, violation of parking limits, occupancy limits, and/or public and private nuisance standards/ordinances.
Additional applicable fees include, but are not limited to:
-Improper Trash Disposal: $50.00 per bag
-Animals: $500.00 per animal
-Glitter/Confetti use: Minimum $500.00 cleaning fee
-Smoking inside the CABIN (including Cigarettes, Cigars, Vape Pens, and/or Marijuana): Minimum $500.00 fee and/or up to the cost to repair, replace, and/or clean damaged property or contents.
-Evidence of Smoking Outside: $500.00 fine for any cigarette/cigar butts left at the CABIN.
-Fines issued by the Sheriff’s Department and/or County Code Enforcement: Minimum of $500.00 per citation/violation (as determined by issuing agency).
-Damage to the CABIN and/or its contents: Actual cost of replacement or repair, as determined by the LANDLORD.
-Security camera tampering: Attempts to turn off, disable, move, re-direct, and/or cover the cameras will result in a fine of $500.00.
-Deep/Extra Cleaning Fees: Actual cost shall be determined by the LANDLORD’s professional cleaners and will be based on the amount of time required to return the CABIN to its original state when received by the GUEST (Minimum $100.00).
-Steam Cleaning of Rugs: Minimum of $250.00 per rug. This fee will only apply if the rugs are not able to be returned to their previous condition with standard vacuuming.
